On Friday, November 2nd, 2007, UM Law School Professor William H. Widen taught a class on reorganization techniques to second and third-year law students taking Bankruptcy Law from Professor George Triantis at Harvard Law School. Professor Reinier H. Kraakman, also at HLS, attended the class. During the lecture, Professor Widen elaborated on the parameters of a context sensitive analysis of the concept of the firm, using illustrations from his recent published article, Corporate Form and Substantive Consolidation (which appeared in the February 2007 edition of the George Washington Law Review) and his ongoing empirical research into substantive consolidation in large public bankruptcies. Both Professor Triantis and Professor Kraakman have authored numerous law review articles exploring the nature of the firm and firm boundaries. The classroom presentation and questions following provided a forum to continue a discussion which has significance both for academic inquiry and for practitioners who reorganize bankrupt companies.
