On Saturday, October 13th, 2007, UM Law School Professor William H. Widen spoke at the American Association of Law Schools Section on Creditors' and Debtors' Rights held in conjunction with the National Conference of Bankruptcy Judges Annual Convention in Orlando, Florida from October 10 through October 13, 2007.


Professor Widen spoke about Structural Challenges for Bankruptcy Reorganizations on a plenary panel dedicated to considering developments since passage of the Bankruptcy Abuse Prevention and Consumer Protection Act of 2005. In his remarks, Professor Widen discussed problems created by an ever expanding class of "protected contracts" that are not subject to the automatic stay, problems created by the absence of disclosure by discount purchasers of claims (such as hedge funds), and a possible interpretation of the Owens Corning bankruptcy decision by the Third Circuit that might complicate future business reorganizations. The Honorable Eugene Wedoff, U.S. Bankruptcy Court, N.D. Ill., provided commentary and perspective on Professor Widen's observations.


The event marked the first time that the AALS Section on Creditors' and Debtors' Rights held a joint meeting with the National Conference of Bankruptcy Judges. Bankruptcy Judges both attended and participated in all AALS Section meeting events and the AALS Section members had reciprocal rights to attend NCBJ events. The ABA Business Law Section and the American Bankruptcy Institute also sponsored events at this convention.
