ARTICLE XI, SECTION 7 (Initiative)

TAX LIMITATION: SHOULD TWO-THIRDS VOTE BE REQUIRED FOR NEW CONSTITUTIONALLY-IMPOSED STATE TAXES/FEES? Prohibits imposition of new State taxes or fees on or after November 8, 1994 by constitutional amendment unless approved by two-thirds of the voters voting in the election. Defines "new State taxes or fees" as revenue subject to appropriation by State Legislature, which tax or fee is not in effect on November 7, 1994. Applies to proposed State tax and fee amendments on November 8, 1994 ballot and those on later ballots.

Amendment 2

ARTICLE XI, SECTION 2 (Legislative)

CONSTITUTION REVISION COMMISSION; CONVENING; DUTIES WITH RESPECT TO TAXATION AND STATE BUDGETARY MATTERS Proposing an amendment to Section 2 of Article XI of the State Constitution to change from 1998 to 1997 the convening of the next Constitutional Revision Commission, in conformity with the schedule previously established by the Florida Supreme Court. Removing the restriction upon the commission's authority to examine matters relating to taxation or the state budgetary process that are otherwise to be reviewed by the Taxation and Budgetary Reform Commission every ten years.

Amendment 3

ARTICLE V, SECTIONS 11 AND 12 (Legislative)

JUDICIARY Proposing amendments to the State Constitution to allow judicial nominating commissions to recommend from three up to six persons to fill a court vacancy; and to restructure the Judicial Qualifications Commission and permit additional sanctions for judicial misconduct.

Amendment 4

ARTICLE VII, SECTION 9 (Initiative)

FEE ON EVERGLADES SUGAR PRODUCTION Provides that the South Florida Water Management District shall levy an Everglades Sugar Fee of 1¢ per pound on raw sugar grown in the Everglades Agricultural Area to raise funds to be used, consistent with statutory law, for purposes of conservation and protection of natural resources and abatement of water pollution in the Everglades. The fee is imposed for twenty-five years.

Amendment 5

ARTICLE II, SECTION 7 (Initiative)

RESPONSIBILITY FOR PAYING COSTS OF WATER POLLUTION ABATEMENT IN THE EVERGLADES The Constitution currently provides the authority for the abatement of water pollution. This proposal adds a provision to provide that those in the Everglades Agricultural Area who cause water pollution within the Everglades Protection Area or the Everglades Agricultural Area shall be primarily responsible for paying the costs of the abatement of that pollution.

Amendment 6

ARTICLE X, SECTION 17 (Initiative)

EVERGLADES TRUST FUND Establishes an Everglades Trust Fund to be administered by the South Florida Water Management District for purposes of conservation and protection of natural resources and abatement of water pollution in the Everglades. The Everglades Trust Fund may be funded through any source, including gifts and state or federal funds.

Brevard County Referendum

INFRASTRUCTURE SALES TAX PROPOSITION

Shall the Board of County Commissioners of Brevard County, Florida, be authorized to levy an additional one cent sales surtax for six (6) months only, beginning on April 1, 1997 and terminating on September 30, 1997, for the sole purpose of paying the cost of financing, planning, improving and constructing County jail facilities as permitted under State law?

City of Cocoa Beach Referendum

FUNDING FOR ADVANCE LIFE SUPPORT PARAMEDIC SERVICES TO BE PROVIDED BY COCOA BEACH FIRE DEPARTMENT

Shall the City of Cocoa Beach Advanced Life Support Paramedic Services District, a Dependent Special District, created under Chapter 189, Florida Statutes (1995), be authorized to levy an ad valorem tax on the assessed value of all lands within the city in an amount not to exceed .08 mills per year, commencing January 1, 1997, for the purpose of funding the implementation and operating costs of an advanced life support paramedic services program.

SECTION 7.03, TOWN CHARTER
COUNCIL CANDIDATES TO RUN FOR SPECIFIC COUNCIL SEATS

The Charter currently provides that candidates for Councilmember (other than the Mayor) run against each other. Candidates receiving the highest number of votes cast shall be ranked according to votes received from highest to lowest, with the highest declared elected to fill the number of vacant Council positions. The amendment provides that candidates shall run for a particular Council seat. The candidates receiving the highest number of votes cast for a particular seat wins.

INDIALANTIC TOWN CHARTER AMENDMENT
SECTION 6.03, TOWN CHARTER

The amendment requires approval by a majority vote of the Town electors voting for the Town to borrow money if the amount of proposal to borrow money, individually or in combination with all other then outstanding indebtedness, exceeds 10% of the Town's then existing budget. Refinancing of bonded indebtedness, or issuance of indebtedness made in response to acts of God, or war, or weather induced calamity, would not be subject to a referendum.

AMENDMENT TO SECTION 2.02(1), MELBOURNE CITY CHARTER -
MAYOR AND COUNCILMEMBER TERM LIMITS

Shall the Charter be amended to provide that: The Mayor and all Councilmembers are limited to serving two complete consecutive terms and the portion of an unexpired term ocurring by reason of a vacancy starting with the terms resulting from the general election of November 5, 1996; and City elected officials who resign within one year before the end of the second consecutive term may not seek re-election in the next regular election.

BOND REFERENDUM
PUBLIC SAFETY CAPITAL IMPROVEMENTS

Shall the City of Titusville impose 1.4 mills of ad valorem tax per year for no more than five years pledging the city's limited taxing powers to finance public safety capital improvements (police and fire rescue) and issue no more than $5,500,000 ad valorem tax bonds bearing interest not exceeding the maximum legal rate when sold, and not exceeding five annual installments.
