NOTICE OF FILING SETTLEMENT AGREEMENT

Plaintiff United States and Defendants South Florida Water

Management District and Timer E. Powers in his official capacity as

Interim Executive Director of the South Florida Water Management

District; and the Florida Department of Environmental Regulation

and Carol M. Browner in her official capacity as Secretary of the

Florida Department of Environmental Regulation respectfully wish to

inform the Court that they have entered into the attached

Settlement Agreement.

These Parties request an oral hearing regarding approval of

the Settlement Agreement and to determine what, if any, further

proceedings the Court wishes to hold regarding resolution of the

above matter between them and all other parties.
