A bill to be entitled

An act relating to public access to records relating to

aquifer storage and recovery wells and other underground

injection control programs; creating s. 403.0879, F.S.;

requiring semiannual reports by the Department of

Environmental Protection regarding aquifer storage and

recovery wells and other underground injection control

programs; providing requirements for the report; providing

an effective date.

Be It Enacted by the Legislature of the State of Florida:

Section 1. Section 403.0879, Florida Statutes, is created

to read:

403.0879 Reports on aquifer storage and recovery wells and

other underground injection control programs.--The department

shall publish on its public website, no later than 60 days

following the end of the 6th and 12th month of each calendar

year, a report containing cumulative statistics on the usage of

Florida’s aquifers for the state’s aquifer storage and recovery

wells and other underground injection control programs. Such

report shall include, at a minimum:

(1) The number of wells permitted, by type.

(2) The permit numbers for all permitted wells, the

applicant or operator, the date of application, and the date of

issuance for each permit.

(3) The injection zone, depth, and permitted flow rate for

each permitted well.

(4) The location, including county, of every such well,

and statistics attesting to the verified recovery rate in the

case of aquifer storage and recovery wells.

(5) The classification of treatment such water received

prior to injection, the source of such injected water, the

amount of injected water, and the amount of water recovered

during each operational cycle.

The requirements of this section shall include information on

all injection wells as defined in subsection 62-528.200(37),

F.A.C., that are used to inject any amount of water. Included in

this definition are test injection wells as defined in

subsection 62-528.200(58), F.A.C., that are used to inject any

amount of water.

Section 2. This act shall take effect July 1, 2003.
