Law Research Guides: Family Law

As defined by Black's Law Dictionary, family law is "the body of law dealing with marriage, divorce, child custody and support, child abuse and neglect, paternity, juvenile delinquency, and other domestic relations issues." Family law is created primarily at the state level and the law related to family issues varies between states. This guide will focus on family law in the state of Florida, while providing some general family law resources which have a broader applicability.

 Secondary Sources

For those unfamiliar with the area of family law, a secondary source is a good way to get started. Consider consulting a preeminent treatise such as:

  • Fundamental Principles of Family Law, by Lynn D. Wardle & Laurence C. Nolan, Treatise Collection KF505 .W374 2002, or
  • Family Law and Practice, by Arnold H. Rutkin, & Myrna Felder, available in Lexis.

Or a preeminent Florida State treatise, such as:

Periodicals, Indexes, and Books are also a good place to start.

 Florida Law

Family law is created almost exclusively at the state level, though some states have adopted Uniform or Model Laws. This guide will focus primarily on Family Law in the state of Florida, however, to compare family law between states consider consulting a compilation of state laws:

 Statutes

Most statutory law will be under Title XLIII, the Domestic Relations section of the Florida Statutory Code. This section is comprised of the following chapters:

Under Title VI, the Civil Practice and Procedure section, Chapter 61 on Dissolution of Marriage, Support, and Custody, and Chapter 63 on Adoption are also relevant.

 Regulation

The State of Florida website provides a helpful guide that refers users to the proper agency depending on the specific area of health or family law. One major agency regulates domestic relations in the state of Florida, the Florida Department of Children and Families. Regulations issued by this agencies can be found in Florida Administrative Code, under Volume 11 Title 65. The Florida Department of Revenue is responsible for the regualtion of child support, and this agency's regulation can be found under Volume 3 Title 12E.  Case Law

There are a number of ways to located cases regarding Family Law in Florida State. When searching in print, the index to the Southern Reporter is a good place to start.

  • Westlaw - In the main search bar start typing "Florida Family Law" and choose the option "Florida Family Law: Cases" from the search suggestions.
  • Lexis - Use either the Florida Family Law Reporter database or the Florida Family Law Case Summaries database listed above. Either click the links or start typing the name of the database in the search bar and select it from the search suggestions.

Bloomberg - Select Court Opinions under the Search & Browse tab. When arriving at the new next screen click the browse button next to Select Topic and scroll down to "Family Law."

 Practice Materials

Westlaw offers a Florida Family Law Practice Center. In addition both Westlaw and Lexis provide access to Florida Family Law Forms.
